Valid Government ID Required

All customers must present valid, unexpired government-issued photo identification before any purchase. Acceptable forms of ID include: state-issued driver's license, state identification card, United States passport or passport card, and United States military ID. We reserve the right to refuse service if identification cannot be verified.

No Exceptions

We do not accept expired IDs, digital IDs, photos of IDs, or any non-government-issued identification. If you cannot present valid ID, we cannot complete your transaction regardless of apparent age.

Walk-In Retail

Take N' Toke operates as a walk-in retail cannabis dispensary at 994 Atlantic Avenue, Brooklyn, NY 11238. All purchases must be made in person at our physical location.

No Delivery

We do not currently offer delivery services. All products must be purchased and picked up at our Atlantic Avenue location. This policy may change in the future as New York State regulations evolve.

Product Availability

Product selection and availability vary based on supply, regulatory requirements, and seasonal factors. We make no guarantees that any specific product will be available at any given time. Our menu is subject to change without notice.

Purchase Limits

All sales comply with New York State possession limits for adult-use cannabis. We reserve the right to limit quantities per transaction as required by law or at our discretion.

Pricing

All prices displayed in-store and on our website are subject to change without notice. Prices include the product cost but do not include applicable state and local cannabis taxes, which are added at the point of sale.

Payment Methods

We accept cash and debit card transactions. Due to federal banking regulations surrounding cannabis, credit card acceptance may be limited. An ATM is available on-site for your convenience.

All Sales Final

Due to the nature of cannabis products and regulatory requirements, all sales are final. We cannot accept returns, exchanges, or provide refunds on cannabis products once a transaction is complete. If you believe you received a defective product, please speak with our staff immediately.

Take N' Toke shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our products or services, including but not limited to personal injury, property damage, or any other damages resulting from the use or misuse of cannabis products.

Our total liability for any claim arising from these terms or your use of our products shall not exceed the amount you paid for the specific product giving rise to the claim.

Take N' Toke operates under a valid Adult-Use Retail Dispensary license issued by the New York Office of Cannabis Management (OCM). We comply with all applicable provisions of the New York Cannabis Law (Marijuana Regulation and Taxation Act) and OCM regulations.

Regulatory Requirements

Our operations adhere to all OCM requirements including seed-to-sale inventory tracking, product testing and labeling standards, packaging requirements, advertising restrictions, and record-keeping obligations. Any changes to state regulations will be reflected in our operations and these terms.

Consumer Protections

As a licensed dispensary, we are subject to OCM oversight and inspection. If you believe we are not operating in compliance with state regulations, you may file a complaint with the New York Office of Cannabis Management.

Photograph or record other customers without their consent.

These Terms of Service shall be governed by and construed in accordance with the laws of the State of New York, without regard to conflict of law principles. Any disputes arising from these terms or your use of our services shall be resolved in the courts of Kings County, New York.

If any provision of these terms is found to be unenforceable or invalid by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.
